The tenant from #3 wrote to us, advising us that as of the end of next month she would be moving, terminating her contract with us. As owners or managers, we each have procedures we follow based on such a notice.
As a reminder, way back in 2003, another wrinkle was added to our business. It is the “INITIAL INSPECTION” that is mandated by an addition to Section 1950.5 of the California Civil Code. A subsequent addition (1950.5(f)) added that .... based on the inspection, the landlord or agent MUST prepare an itemized statement of repairs or cleaning that the landlord or agent believes the tenant should perform to avoid deductions from the tenant’s security deposit.

At first glance, this legislated requirement of a pre- inspection seemed to be a huge time-liability for landlords. However, this turned out to be one of those lemon vs. lemon-aid things. It’s all in how you put it together.
Here’s what we do to deal with this legal reality.
We are created a form. It is our MOVE-OUT CLEANING INSTRUCTIONS (subtitled: “How to Get a Full 100% Refund of Your Security Deposit”). Copy available on request. We send it to every tenant who notifies us of their intent to move. It’s a detailed check-list of how to clean an apartment and suggestions on how to un-do the most common tenant-caused damages (such as nail-holes).
